Just now, a judge has granted a temporary order stopping the scheduled execution of #RobertRoberson, who has maintained his innocence for over two decades. The Office of the Attorney General says it will appeal this decision.

Robert Roberson, an autistic man with an 8th grade education, whose two-year-old daughter died from medical malpractice, has spent twenty years on death row after being charged with murder, based on the discredited “shaken baby syndrome” theory. His daughter Nikki had been sick with pneumonia and was given inappropriate medications that are documented to cause breathing problems and death. Nikki died after being given those medications.
The state of Texas plans to execute Mr. Roberson tonight at 7:00 CST.

A judge granted a temporary order on Thursday stopping the execution of an East Texas man who has maintained his innocence for over two decades.
Robert Roberson III, 57, was set to be executed Thursday at 6 p.m. for the 2003 capital murder conviction in the death of 2-year-old daughter Nikki Curtis that has been highly contested.
But under two hours before the scheduled execution, Travis County District Judge Jessica Mangrum granted a temporary restraining order on the grounds of the subpoena for Roberson that was issued by the Texas House Committee on Criminal Jurisprudence late Wednesday night…
…The temporary order stopping Roberson's execution shall be valid for 14 days and a hearing will be held in Travis County on Oct. 31 to consider a temporary injunction. The state is planning to appeal the temporary restraining order.
In 2003, Roberson was convicted of capital murder in the death of his 2-year-old daughter Nikki Curtis, who was found unresponsive and taken to the hospital by Roberson. He maintained his innocence for roughly two decades with his lawyer citing junk science as the reason for his conviction.
His defense team has long said that Nikki's death was not caused by abuse or violent shaking as suggested in Roberson's 2002 trial, but an autopsy showed she had undiagnosed pneumonia and had been prescribed opioids.
The defense says the now-debunked "Shaken Baby Syndrome" hypothesis, which no longer holds up scientifically, was used to convict Roberson. A 2013 Texas junk science law in question allows people to challenge wrongful convictions by showing changes in the field of forensic science…

There is a double tragedy in this case in that a young child died and an innocent father has been imprisoned for over 20 years with the threat of execution by lethal injection hanging over him the whole time. The thought also crossed my mind that both the SIDS and autism could have been the result of injections.
I don't live in the US, and I hadn't heard about Mr. Robinson's case until yesterday. I will keep him in my prayers and share his story. The more publicity his story gets, the more likely he is to be pardoned or have his conviction quashed.
