NJ's A1884 (aka the "Just Following Orders" Bill) will handcuff doctors to pathological medical groupthink
A1884 is scheduled to be heard before the Assembly Health Committee on Monday. The bill, which “establishes act of disseminating misinformation as professional misconduct for health care professionals,” would reduce health care practitioners to technicians who can only assert scientific consensus and apply medical protocols.
A1884 states:
A health care professional who engages in the dissemination of misinformation or disinformation shall be deemed to have engaged in professional misconduct in violation of subsection e. of section 8 of P.L.1978, c.73 (C.45:1-21) and shall be subject to disciplinary action pursuant to P.L.1978, c.73 (C.45:1-14 12 et seq.).
“Misinformation” means any health-related claim of fact that is false and contradicted by contemporary scientific consensus contrary to the standard of care.

Can doctors “First Do No Harm” with their hands tied?
Things can get dangerous when health care practitioners are censored and prohibited from practicing medicine to the best of their abilities. Consider what the contemporary scientific consensus has been during the COVID era:

Over the last several years, the goal of public health has strayed from health itself and moved towards compliance. The focus has shifted towards creating legislation that chips away at individual and parental rights. Doctors have been recruited to manufacture consent and promote narratives that create vaccine confidence “or else.”
COVID pandemic measures further revealed the regulatory stronghold on health care practitioners. Throughout the pandemic, doctors and hospitals were incentivized and rewarded for applying protocols. Those who asked questions, pointed to problems or posed alternative solutions were often silenced or punished.
The results of this experiment are coming in. And they are tragic.

Liability free COVID protocols killed people en masse.
Here is Dr. Paul Marik - who had his board certifications in internal medicine and critical care revoked for saving lives outside the lines - describing the COVID treatment protocols that doctors were coerced to apply and the “science” that was used to support it. This was January, 2022:
So what the NIH and other agencies have ignored are multiple FDA approved drugs… these are not experimental drugs, which are cost effective and safe and have unequivocally been shown to reduce the death of patients in the ICU and in hospital. For example, there are 25 high quality… randomized controlled trials that show that ivermectin reduced the risk of death by 26%. This is an extremely safe and cheap drug. In fact it is one of the safest drugs on this planet. You are more likely to die from taking Tylenol than ivermectin, yet the FDA calls this a dangerous horse deworming medicine….
There are a whole host of drugs that have been proved highly effective for the treatment of hospitalized patients… so the question is why? Why have cheap, safe and effective drugs been ignored for the treatment of COVID-19 which could have save maybe 500,000 lives?

What’s the End Game?
Another way to understand the impact of bills like A1884 is to examine the goals and ideals of the people who support them.
A1884 sponsored by Assembly Herb Conaway, who is currently running for Congress. As Assembly Health Committee Chair, Conaway has been able to determine which bills are heard in committee and which ones never see the light of day.
Since 1998, Conaway has also served in New Jersey’s General Assembly and chaired Assembly Health Committee for over a decade. He is also the Director of the Burlington County Health Department, where he has a role in implementing some of the laws he helps make.
Importantly, Assemblyman Herb Conaway is a staunch vaccine supporter and has played a leading role in most of the major health legislation signed into law during his extensive tenure as health chair. His political career can be credited for many of the medical mandates in New Jersey…
The Democratic lawmaker is skilled at identifying and eliminating any obstacles that stand in the way of vaccine compliance, which may explain why pharmaceutical interests have been so supportive of him. His personal and professional beliefs make him an asset to the pharmaceutical companies and his proposals and assertions have aligned with pharmaceutical agendas for throughout his lengthy political career.
Conaway has made his position on vaccines abundantly clear. In 2015, his bill to restrict religious exemptions was met with strong resistance from constituents, who addressed concerns about government interference in personal health decisions and the exercise of religious freedoms. His response:
“We’ve heard too many people playing politics with vaccinations, despite vaccinations having been proven as a vital public health success story. In the end, the only thing government must balance is what’s best for the overall public health, and that means unambiguously supporting vaccinations and making clear that any exemptions must be limited.”
…Conaway’s penchant for government interference in patient decisions shifts considerably when it comes to the regulation of opioids. More than once he blocked legislation that was geared towards limiting opioid abuse, saying,
“The concerns that I have deal with intrusions by the government in the doctor-patient relationship…That relationship is critical to patients receiving the care they need. It’s critical to good outcomes in healthcare.”
Lessons from California’s AB2098
California has famously hamstrung doctors in various ways and attempted to implement similar legislation. Gavin Newsom signed AB2098 into law in September 2022 only to repeal it last year.
California Gov. Gavin Newsom has signed a bill to repeal a law that would have subjected physicians to discipline for sharing information that departs from the “contemporary scientific consensus” on Covid-19 with their patients. NCLA celebrates this great victory for its brave clients, who stood up to this outrageous attack on the First Amendment: Drs. Tracy Hoeg, Ram Duriseti, Aaron Kheriaty, Pete Mazolewski and Azadeh Khatibi, in Høeg, et al. v. Newsom, et al., a lawsuit challenging the vague and censorious statute.

It would be absolutely chilling on the practice of medicine. It would become almost impossible to practice medicine the way we are trained to, which is to use our objective reasoning, to share our ideas with our patients, and to come up with the best possible recommendation for that particular patient for that particular circumstance. So I’m gravely, gravely concerned about that.

"A new bill being heard in committee today will define disseminating so-called "disinformation" as professional misconduct. That means a doctor who disagrees with something like a push from big pharma to get flu and COVID shots (knowing that they simply do not prevent you from catching either) could lose his or her license.
This is a clear violation of the rights of medical professionals to offer individualized care and have confidential conversations with patients. I can only imagine the "testers" who will likely emerge from this draconian bill to "catch" docs in the act of opposing groupthink."
